9. REFUND POLICY

The conditions for refund

1. The payment appears to have gone through successfully, but it hasn't been credited to the player's account.

How to refund

10. Termination by User

Provided that any applicable restrictions on Cash Withdrawals are adhered to as outlined in this Agreement, the Company will process a refund of any remaining Cash Balance to you at that time.

11. Cash Balance in Virtual Accounts

11.1 - To take part in Cash Games, you must maintain a positive Cash Balance in your account.

11.2 - The Cash Balance consists of two parts: funds in your Chips Account and those in your Winnings and Bonus Account. As it pertains to this Cash Balance, you understand and agree to the following:


a) All funds credited to your Chips Account (known as \"Cash Credits\") must be processed through the third-party payment gateways provided by the Company on the Platform. The Company is not liable for the approval or disapproval of any such transactions, which must comply with the terms specified by those payment gateways. The Company reserves the right to reverse any transaction, in which case the relevant amount will be refunded to the account or instrument used in the transaction.


b) Users acknowledge that all funds credited to the Chips Account by them will remain under the Company's trust until they are deducted for participation in Cash Games.


c) All Cash Credits must originate from financial instruments or accounts that belong to you and are registered in your name.


d) All transactions on our Platform must be conducted in Indian Rupees.


e) Any winnings from Cash Games will be exclusively credited to the Winnings Component of your Winnings and Bonus Account. Additionally, any bonus amounts will also be credited solely to the Bonus Component as specified in Section 20 of this Agreement.


f) Users agree that the Company will assist in collecting and transferring winnings from other participants in the Cash Game to the entitled winner. This amount will be held in the Winnings Component of the Winnings and Bonus Account in trust until the User opts to either play a Cash Game or withdraw the funds, according to the terms of this Agreement.


h) A cash amount that equals the combined balances in the Chips Account and the Winnings and Bonus Accounts of all users is always maintained in a separate, unencumbered bank account by the Company, which does not earn interest. Users may access these Cash Balances for play from their Chips Account or for withdrawal from their Winnings and Bonus Account, subject to specific restrictions outlined in the Agreement. Users' claims to these Cash Balances will take precedence over other claims as permitted by law.


i) Any request for Cash Withdrawal from your Accounts must comply with the terms laid out in this Agreement.


j) The relevant personal information needed for processing payments from ace2three to your account will be shared with our payment partners.


k) The Company may set limits on your daily or per-session transactions for cash credits or Cash Withdrawals to promote responsible gaming and prevent unauthorized or illegal activity. You'll be notified when such limits are established and informed of any adjustments. While you can request changes to these limits, the Company maintains the right to impose or modify limits at its discretion.


l) You can request Cash Withdrawals at any time, adhering to any imposed limits and in accordance with this Agreement. Such withdrawals will be made by bank transfer to your account, and your preferences in this regard will be duly considered. Note that Cash Withdrawals will only be processed to an Indian Rupee account that is in your name.


m) Cash Balances do not accrue interest and are not transferable, except as expressly allowed by this Agreement. Furthermore, no Cash Withdrawal will be facilitated from the Cash Balance tied to each User's Accounts unless the User has played a sufficient number of Cash Games (determined solely by the Company at its discretion) since the last recorded Cash Credit.


n) Cash Withdrawals will only be permitted from the Winnings Component, accrued by participating in the necessary number of Cash Games as prescribed by the Company, and from Bonus Amounts credited by the Company. To clarify, Cash Withdrawals can only occur from the Winnings and Bonus Account. Upon a User's request to withdraw winnings, the Company will process the specified amount accordingly.


o) Cash Credits allocated for participating in Cash Games are not eligible for Cash Withdrawals and can only be used for gaining entry to tables or tournaments. Therefore, no Cash Withdrawal is allowed against chips in the Chips Account.


p) Consequently, when allocating chips from the Cash Balance to secure a place at a table or tournament, the non-refundable portion (the Chips Account) will be deducted first, followed by the refundable portion (the Winnings and Bonus Account), ensuring that the maximum remaining Cash Balance is available for possible refunds through Cash Withdrawals. Furthermore, within the Winnings and Bonus Account, the Bonus Component will be deducted first when adding chips, followed by the Winnings Component.


q). If you maintain a Cash Balance for a period exceeding 300 days and do not engage in any Cash Game during that time, the Company holds the right to forfeit the total amount present in your Chips Account at its discretion. Additionally, the Company will refund the entire sum from your Winnings and Bonus Account that has been inactive for over 300 days to the bank account you have registered with us. Should you not have your bank details on file, we may ask you to provide them in order to process the refund. If you do not submit your bank account details within the specified timeframe, the Company is entitled to forfeit the funds in your Winnings and Bonus Account or take any other actions it finds suitable with those funds. It is important to note that any forfeited amount will be classified as Gross income incurred, which will include any applicable Service Tax or Goods and Services Tax (GST). Please be aware that these conditions can be updated from time to time to align with any changes in relevant tax regulations or other legal requirements.

11.3 - The Company is required to deduct tax at source (known as 'TDS') for winnings exceeding Rs. 10,000 in a single game tournament during Cash Games. In such situations, your winnings will be credited to your Winnings and Bonus Account after a TDS deduction of 30% has been applied. It's crucial to remember that, as stated in Section 6.1, you need to have a valid PAN and provide your PAN information along with verification documents when requested. This is necessary for us to process your winnings and facilitate Cash Withdrawals connected to this amount. If you do not provide valid PAN details within 60 days following the conclusion of the game where your winnings are over Rs. 10,000 and where TDS is applicable, the Company may forfeit your winnings from that game after paying the relevant TDS to the Government authorities. Any forfeited amount will be considered as a Gross charge, which includes applicable Service Taxes or Goods and Services Tax (GST). These guidelines may also be subject to change in accordance with updates to tax laws and other regulations.
